By creating an account or using ThinkSpace (“the Service”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.
ThinkSpace is a collaborative infinite-canvas application that lets users create, organise and share visual spaces. The Service is currently in active development; features and limits may change, but we will provide advance notice of material changes that affect paid subscribers (see Section 15 — Changes to These Terms).
You must provide a valid email address and keep your credentials secure. You are responsible for all activity that occurs under your account. You must be at least 13 years old to use the Service.
You retain ownership of the content you create on ThinkSpace. By using the Service, you grant us a limited licence to host, store and display your content solely for the purpose of operating the Service. We will not sell or share your content with third parties except as required to provide the Service or comply with applicable law.
You agree not to:
Each plan has caps on the number of spaces, items per space, and total stored file size. If you downgrade (or a paid subscription lapses) and your account exceeds the caps of your current plan, you may continue to view and export your existing content within that plan's limits, but you will be unable to create new spaces, add new items, or upload new files until you bring your account back within the caps or upgrade.
If your account remains over the free-tier caps for more than three (3) months after a downgrade, and after at least three (3) email notices to the address on file, ThinkSpace reserves the right — at its sole discretion and only in extreme circumstances — to delete stored image files associated with your account down to the free-tier storage cap in order to reclaim resources. We will always attempt to contact you first and will provide a data-download link so you can export your content before any such deletion. Space structure and non-file content will be preserved; only image binary data is eligible for reclamation under this clause.
Pro subscribers may use the AI image-generation feature, which is powered by Google Gemini. When you use this feature your text prompt is sent to Google’s API for processing. Prompts are not retained on our servers after the response is returned. AI-generated images and any other outputs are subject to Google’s Gemini API terms of service. You are solely responsible for verifying that you have the right to use any generated image for your intended purpose, including assessing ownership, copyright, and any applicable usage restrictions. AI-generated content is provided “as is” and may not always be accurate or suitable for your use case.
We collect the minimum data necessary to operate the Service: your email address, display name, and space content. Passwords are securely hashed and never stored in plain text. We use cookies for authentication sessions only. We do not sell your personal data. For full details, see our Privacy Policy.
When you invite others to a space, they can view and edit its contents. You are responsible for managing access to your spaces. We are not liable for actions taken by collaborators you have granted access to.
ThinkSpace offers the following paid plans: Hobby ($8/month or $79/year) and Pro ($20/month or $192/year). Payments are processed by Stripe. Applicable taxes (including VAT and sales tax) are calculated and collected by Stripe Tax.
Refunds:
We may adjust pricing from time to time. For any increase to the price of a plan you are currently subscribed to, we will notify you by email at least 30 days before the new price takes effect. If you do not cancel before the effective date, the new price will apply at your next renewal.
We maintain nightly automated backups of the database with a 30-day rolling retention window. Backups are encrypted at rest. In the event of a confirmed data loss incident we will notify affected users as promptly as practicable.
While we take reasonable care to protect your data, no system is infallible. We strongly recommend that you keep local copies of any mission-critical content. You can export individual spaces from within the app at any time.
We may suspend or terminate your account, with or without prior notice, if:
Where possible we will give you an opportunity to remedy a breach before suspending access. Following termination, your data will be retained and then purged according to the schedule described in our Privacy Policy. You may delete your account yourself at any time from your account settings; a 7-day grace period applies before the hard delete runs (see Privacy Policy for details).
To the fullest extent permitted by applicable law, ThinkSpace and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including loss of data, revenue, or profits.
Our total aggregate liability to you for any claim arising out of or related to these Terms or the Service shall not exceed the greater of (a) USD $100 or (b) the total fees you paid to ThinkSpace in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits liability for gross negligence or wilful misconduct, or for any liability that cannot be excluded by law.
We will not be liable for any delay or failure to perform our obligations under these Terms where that delay or failure results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, labour disputes, or acts of third-party service providers. We will resume performance as soon as reasonably practicable.
We may update these Terms from time to time. We will notify registered users of material changes via email before the changes take effect. Continued use of the Service after the effective date of any revision constitutes acceptance of the revised Terms. For price changes, the 30-day notice rule in Section 10 applies.
These Terms are governed by the laws of [YOUR JURISDICTION], without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the courts located in [YOUR JURISDICTION], and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThinkSpace regarding the Service and supersede all prior agreements or understandings on the same subject matter.
